Terms & Conditions
Overview
This website is operated by Rogue Metalworks. Throughout the site, the terms “we”, “us” and “our” refer to Rogue Metalworks.
By accessing our website or purchasing from us, you agree to these Terms & Conditions and any policies referenced on our website.
These Terms do not exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable Australian law.
1. Products
We aim to accurately represent our products, specifications, dimensions, materials and finishes.
Many Rogue Metalworks products are fabricated from raw aluminium or stainless steel. Raw materials may contain minor marks, scratches, blemishes, variations in finish or other cosmetic imperfections resulting from manufacturing, handling and fabrication. These are not considered defects where they do not affect the intended function of the product.
Product photographs are representative only. Actual appearance may vary slightly from photographs due to material variation, manufacturing processes, lighting and screen settings.
Unless otherwise stated, dimensions and specifications are subject to normal manufacturing tolerances.
We reserve the right to modify or discontinue products at any time.
2. Orders
By placing an order, you confirm that all information supplied is accurate and that you have checked the product description, dimensions, specifications and compatibility before purchasing.
Orders may be accepted or declined at our discretion, subject to applicable law.
Once an order has entered production, been fabricated, customised or otherwise prepared specifically for you, cancellation may not be possible.
3. Custom and Made-to-Order Products
Customers are responsible for ensuring that measurements, specifications and other information supplied for custom products are correct.
Rogue Metalworks is not responsible for fitment issues resulting from incorrect measurements or information supplied by the customer.
Custom and made-to-order products cannot be returned or exchanged for change of mind.
Nothing in this section limits your rights under Australian Consumer Law.
4. Pricing and Payment
All prices are displayed in Australian dollars unless otherwise stated.
Prices may change without notice. The price applicable to an order is the price displayed and accepted at the time the order is placed.
Shipping or other applicable charges will be displayed or communicated before the order is finalised where applicable.
Payment must be made using an accepted payment method.
5. Shipping and Collection
Shipping and delivery timeframes are estimates and may vary.
Rogue Metalworks is not responsible for delays outside our reasonable control, including delays caused by freight or courier providers.
Customers must provide accurate delivery information. Additional costs resulting from incorrect delivery information may be charged to the customer where permitted by law.
Where local pickup is offered, customers will be notified when their order is ready for collection.
Nothing in this section excludes any rights or remedies available under Australian Consumer Law.
6. Installation and Fitment
Customers are responsible for ensuring products are installed correctly and are suitable for their intended application.
Where appropriate, installation should be carried out by a suitably competent or qualified person.
Rogue Metalworks is not responsible for loss or damage caused by incorrect installation, misuse, modification, improper maintenance, use outside the product's intended purpose, or failure to adequately secure or inspect a product, except to the extent that liability cannot lawfully be excluded.
Customers are responsible for ensuring their vehicle and any modifications comply with applicable road, registration and engineering requirements.
7. Returns and Refunds
We do not accept returns or exchanges for change of mind, incorrect selection or incorrectly ordered products.
Customers should carefully review product descriptions, dimensions and compatibility before ordering.
If a product is faulty, damaged, incorrectly supplied or otherwise fails to meet a consumer guarantee under Australian Consumer Law, please contact us so the issue can be assessed and an appropriate remedy provided.
Custom and made-to-order products cannot be returned for change of mind.
8. Australian Consumer Law
Our products come with guarantees that cannot be excluded under Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy available to you where doing so would be unlawful.
